TERMS OF SERVICE

Effective date: September 18, 2025

These Terms of Service ("Terms") govern your access to and use of screencap.dev433.com and the related services (collectively, the "Service"). By using the Service, you agree to these Terms and our Privacy Policy and Cookie Policy.

If you are accepting these Terms on behalf of an organization, you represent that you are authorized to bind that organization.

1) Eligibility & Account Registration

  • You must be at least 18 years old or have reached the age of majority in your jurisdiction.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  • Notify us immediately at contact.dev433@gmail.com if you suspect unauthorized access.

2) Use of the Service

  • You may use the Service only for lawful purposes and in accordance with these Terms.
  • You agree not to misuse the Service, including by interfering with its security or integrity, reverse engineering, or using automated means to access or scrape data.
  • We may suspend or terminate access if we believe you are violating these Terms or applicable law.

3) Subscriptions, Payments & Refunds

  • Paid features may be offered on a subscription basis. Billing is handled by Stripe on our behalf.
  • Fees, billing cycles, and cancellation terms are presented at checkout. Unless stated otherwise, subscriptions renew automatically until cancelled.
  • You may cancel future renewals at any time through your account or by contacting us. We do not provide refunds for partially used billing periods unless required by law.

4) Intellectual Property

  • All software, documentation, logos, and other content made available through the Service are owned by DevDeveloper433 or its licensors and are protected by intellectual property laws.
  • We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
  • You retain ownership of the content you submit. You grant us a license to host, display, and process that content solely as needed to operate the Service.

5) User Content & Acceptable Use

  • You are responsible for the legality and accuracy of any content you upload or generate.
  • You agree not to submit content that is unlawful, infringing, defamatory, obscene, or harmful to others.
  • We may remove or disable access to content that violates these Terms or law.

6) Privacy & Data Protection

  • Our Privacy Policy explains how we collect and use personal data.
  • Our Cookie Policy describes how we use cookies and similar technologies.
  • You agree to these policies when you use the Service.

7) Third-Party Services

  • The Service integrates with third-party providers (including Google OAuth, Google Analytics, Google AdSense, and Stripe).
  • Third-party services are governed by their own terms and policies. We are not responsible for their content or practices.

8) Disclaimers & Limitation of Liability

  • The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
  • To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • To the extent permitted by law, DevDeveloper433 will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service.
  • Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid to us for the Service in the 12 months before the claim.

9) Indemnification

You agree to indemnify and hold harmless DevDeveloper433 and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorney fees) arising out of your use of the Service or violation of these Terms.

10) Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination will remain in effect.

11) Changes to These Terms

We may update these Terms from time to time. The "Effective date" above indicates when the Terms were last revised. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

12) Governing Law

These Terms are governed by the laws of the jurisdiction where DevDeveloper433 is established, without regard to conflict-of-laws principles. Local mandatory consumer rights remain unaffected.
